1. About Akaw

Akaw is a web-based platform that lets individuals and organizations create fundraising campaigns and lets supporters contribute to those campaigns. The platform is provided by Akaw (“we”, “us”, “our”).

2. Acceptance of Terms

By creating an account, visiting the site, launching a campaign, or making a contribution, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the platform.

3. Eligibility and Accounts

• You must be at least the legal age of majority in your jurisdiction or have legal authorization to contract.
• You are responsible for keeping your login credentials secure and for all activity under your account.
• Provide accurate, up-to-date information (name, email, phone number, profile details). We may request verification documents for profiles, payouts, or compliance checks.

4. Campaigns

• Campaign creators (“Creators”) are solely responsible for the accuracy, legality, and completeness of their campaigns (reason, description, images, targets, timelines, proofs, and updates).
• Creators must use funds only for the stated purpose and must comply with applicable laws, including charity, tax, financial, and sanctions rules.
• We may request proof of use of funds or identity; we may suspend or remove campaigns that appear misleading, fraudulent, or non-compliant.
• Withdrawals are subject to review; Creators must provide correct payout details and supporting documents when requested.

5. Contributions and Payments

• Contributors (“Donors”) choose the contribution amount, payment method, and visibility level (e.g., anonymous, first name, full name).
• Payment processing may involve third-party gateways; fees (gateway and platform) may apply and are shown or embedded in the flow.
• A contribution does not guarantee outcomes; it is not a purchase of goods or services. Refunds are not guaranteed once a payment is captured unless required by law or a gateway rule.

6. Fees

• Gateway fees and platform fees may be deducted from contributions.
• We may update fee structures; changes apply to future transactions only.

7. Notifications and Communications

• We may notify users about campaign status, milestones, verifications, payments, and product updates via email, in-app messages, or phone/WhatsApp (where provided).
• You can adjust notification preferences where options are available; some service notifications are mandatory.

8. Content and Intellectual Property

• You retain rights to the content you upload but grant us a non-exclusive, worldwide license to host, display, and distribute it for operating the platform.
• Do not upload content that is illegal, infringing, abusive, defamatory, or deceptive. Respect image and text rights.

9. Prohibited Uses

You may not use the platform for: money laundering; terrorism financing; hate, violence, or harassment; illicit goods or services; fraud; phishing; or any activity violating applicable law or third-party payment rules.

10. Disclaimer and Limitation of Liability

• The platform is provided “as is” without warranties of any kind.
• We do not control how Creators use funds and are not liable for campaign outcomes.
• To the fullest extent allowed by law, we are not liable for indirect, incidental, special, or consequential damages arising from the use of the platform or third-party services.

11. Indemnity

You agree to indemnify and hold Akaw harmless from claims, losses, or expenses (including legal fees) arising from your use of the platform, your campaigns, or your breach of these Terms.

12. Suspension and Termination

We may suspend or terminate accounts or campaigns without notice for suspected fraud, policy violations, legal requests, or risk to users. You may stop using the platform at any time.

13. Changes to These Terms

We may update these Terms periodically. Material changes will be communicated where feasible. Continued use after updates means you accept the revised Terms.

14. Governing Law

These Terms are governed by the laws of the applicable operating country of Akaw, without regard to conflict-of-law principles. Local mandatory consumer rights remain unaffected.
